Delaware DBA Holders: Mandatory Re-Registration Deadline Extended

Attention Delaware Corporations and LLCs! If you have a “Doing Business As” (DBA) name, you will need to re-register it at the state level.  

The Delaware General Assembly recently enacted House Bill 40, which unifies the state’s previous county-by-county registration process at the state level. Previously, companies were required to register their DBA name separately in each county, but now, House Bill 40 allows companies to register this name once with the Delaware Division of Revenue.  

As a result of House Bill 40’s enactment, companies that have previously registered a DBA name at the county level must re-register that name at the state level if they wish to keep it. Registration at the state level opens on February 2nd, 2026. 

If a company fails to re-register its DBA name during the re-registration period, that name will become publicly available on a first-come, first-served basis. To ensure that you don’t lose your previously registered DBA name, we recommend re-registering your name as soon as possible after registration opens.  

The Division of Revenue will send a letter with more information to existing DBA name holders at the address they currently have registered. The Division of Revenue will also be updating its site through the summer and fall as the registration period gets closer: https://revenue.delaware.gov/trade-names-faqs/.   

Starting February 2nd, you can register your DBA name at Delaware’s One Stop portal: https://onestop.delaware.gov/
