BrownWinick’s Estate Planning practice group assists clients and advisors to create wealth transfer plans that provide for beneficiaries, minimize taxes, and provide support for charitable organizations. Each plan is holistically tailored to integrate individual, family, and business planning to achieve the client’s goals. These plans range from routine wills to complex estate plans. A significant portion of the estate planning practice is devoted to the preparation and implementation of wills, trusts, powers of attorney and other estate planning documents. The firm also has extensive experience in the administration of trusts and estates; the preparation of the required estate, gift and inheritance tax returns; the administration of conservatorships and guardianships; and litigation regarding estates and trusts.
An individual’s estate plan often calls for more planning than a traditional will or trust. BrownWinick attorneys regularly advise clients on the creation and implementation of planning tools such as revocable trusts, life insurance trusts, annual exclusion gifting programs, family limited partnerships, deferred compensation arrangements, retirement benefit planning, and charitable structures. BrownWinick’s experience also extends to planning for the wealth transition of a family or closely-held business to the next generation of family or non-family owners.

Representative Cases
Probate/Estate
We currently represent a national bank in a probate proceeding and a separate lawsuit involving a $3.5 million fraudulent loan obtained from the bank by the decedent, who thereafter committed suicide.

Estate and gift tax concerns the transfer of assets (usually from an older generation to a younger one). The goal of estate and gift tax planning is to transfer assets effectively and efficiently for the lowest tax cost. If the assets being transferred are not easily valued, the taxpayer needs to value those assets in a manner acceptable to the IRS. Valuation concerns usually arise with family business entities.

On July 29, the U.S. Supreme Court ruled in the case of U.S. v. Windsor that Section 3 of the Federal Defense of Marriage Act ("DOMA") is unconstitutional on equal protection grounds. Section 3 of DOMA states that for purposes of federal law, "marriage" is defined as a legal union between one man and one woman as husband and wife, and "spouse" refers only to a person of the opposite sex who is a husband or a wife.
